Telus Gets Injunction Against Rogers Claims

The British Colombia Supreme Court has granted Telus a temporary injunction against Rogers Wireless.  The issue has been that Telus claims that the ads run by Rogers are not true.  The ads from Rogers state “Canada’s most reliable network” and has speeds “two times faster than any other”.  Telus has disputed these claims based on their recently introduced 21 mbps HSPA network.

TelusTelus Corporation, a leading telecommunications company from Alberta Canada filed the suit against Rogers on November 12th, 2009 in hopes Rogers would stop its claims that it is Canada’s fastest and most reliable cell phone network. Several factors have led to the Telus recent decisions.  Telus began upgrading its system and completed the transition on November 5th.  The company believed that Rogers statements about its fastest and more reliable services were no longer true.  Telus company officials had asked Rogers to stop using the claims.  Of course Rogers declined to do this.

Believing that Rogers is making false claims, the company pursued the lawsuit.  The lawsuit states that Rogers is making false statements and should cease doing so.  Rogers officials have denied the claims and have indicated that Telus has no research or factual basis to its suit and looked forward to defending themselves in court.

Upon gaining its day in court, Rogers failed to supply enough evidence and documentation to support its claims.  Rogers also admitted it could no longer claim to be the fastest network due to Telus’ upgrades.  Rogers officials felt that they would win on the reliability issues but failed to convince the court.  Therefore the injunction was granted to Telus.  Rogers Wireless has filed an appeal.  No date has yet been set for the appeals process.  The company must return to the court on November 27 to begin determining how and when ads will be pulled.
